According to the Indian Motor Vehicle Act 1932, only an ASI level officer can issue a challan for traffic violation. Only SI, ASI, Inspector have the right to impose spot fine. Apart from this, traffic constables are there only to assist them. Traffic constables cannot take out the keys of any vehicle. Along with this, they cannot let out the air from the tyres of the vehicle nor can they misbehave with you.

  • If you are fined for any mistake, then the first thing you should take care of is that the traffic police should have a challan book or an e-challan machine. If the traffic police does not have any of these two things, then your challan cannot be fined.
  • The second thing is that it is very important for the traffic police to be in uniform. The uniform should have a buckle and name. If in any situation he is not wearing the uniform, he may be asked for an identity card.
  • If a traffic constable takes out the keys of your vehicle, then immediately make a video of it and you can go to the police station of the same area and complain about it to the senior officer.
